Terms of Service
Effective July 10, 2026
These Terms of Service ("Terms") govern your use of the Lattice platform — the hosted web application, APIs, device ingest endpoints, Foundry design tools, and public storefronts (collectively, the "Service") — operated by [COMPANY LEGAL NAME] ("Lattice", "we", "us"). By creating an account or using the Service you agree to these Terms. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.
1. Accounts
You must provide a valid email address and keep your credentials confidential. You are responsible for all activity under your account, including activity by members you invite to your organizations and by devices provisioned with your device tokens. Notify us promptly if you believe your account or a device token has been compromised.
You must be at least 16 years old (or the minimum age required in your jurisdiction) to use the Service.
2. The Service and plan limits
The Service lets you connect devices, ingest telemetry, build dashboards and rules, send device commands, design hardware, and publish storefronts. Each plan carries published limits — devices, messages per day, rules, designs, retention, and seats — described on the pricing page. When a limit is reached, the Service rejects further requests of that kind (for example, telemetry ingest returns HTTP 429) rather than charging overages.
Foundry's manufacturing and fulfillment pipeline is a simulation. Production runs, inventory, shipments, carriers and tracking numbers generated by Foundry are virtual: no physical goods are manufactured or shipped by Lattice, and storefront checkout does not collect payment. You are solely responsible for any real-world manufacturing, sales or fulfillment you conduct using artifacts exported from the Service.
3. Acceptable use
You agree not to use the Service to:
- operate devices, or collect data, in violation of applicable law — including covert surveillance or interception of communications without consent;
- ingest data you do not have the right to collect or process, including personal data collected without a lawful basis;
- operate safety-critical systems where a Service failure could cause death, personal injury, or severe damage (for example, life support, weapons, or aviation control);
- probe, disrupt, or circumvent the Service's security, isolation, or rate limits, or access another customer's data;
- resell or white-label the Service without our written agreement;
- send spam or malicious payloads through alert channels or storefronts.
We may suspend accounts that violate this section, and will tell you why unless the law prevents it.
4. Your data
You own your data. Telemetry your devices send, dashboards and rules you build, hardware designs you create, and storefront content you publish remain yours. You grant us the limited rights needed to store, process, and display that data in order to operate the Service — nothing more.
Telemetry is retained for the period defined by your plan (30, 90 or 365 days) and then deleted on a rolling basis. You can delete devices, designs, projects and organizations at any time; deletion removes the associated data from the live systems and from backups on the backup rotation schedule.
If you ask us to delete your account, we will delete it and its data within 30 days, except records we must keep by law.
5. Storefronts and buyers
If you publish a storefront, you are the seller of record for anything you offer, and you are responsible for the accuracy of your product claims and for handling buyer information you receive in accordance with the Privacy Policy and applicable law. While checkout is in demo mode, no payment is collected from buyers, and storefront orders are simulated.
6. Fees
The Free plan is free. Paid plans are billed at the prices shown on the pricing page. Paid checkout is not yet enabled; when it is, we will bill in advance on a monthly basis, you may cancel at any time, and cancellation stops future charges without clawing back the current period.
7. Subprocessors
We run the Service on infrastructure providers acting as subprocessors, currently Vercel (application hosting) and Supabase (database, authentication and storage). The current list is maintained in the Privacy Policy.
8. Intellectual property
We retain all rights to the Service's software, design and branding. Firmware generated by Foundry from your designs is yours to use, modify and distribute; parts catalogs and reference data remain part of the Service.
9. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that telemetry will never be delayed or lost.
10. Limitation of liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential or punitive damages, or lost profits, revenues or data. Our total liability for all claims arising out of the Service is limited to the greater of (a) the amounts you paid us in the 12 months before the claim and (b) US $100. Nothing in these Terms excludes liability that cannot be excluded by law.
11. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate accounts for material breach of these Terms, with notice where practicable. On termination, the data-deletion commitments in Section 4 apply.
12. Changes to these Terms
We may update these Terms from time to time. For material changes we will give at least 14 days' notice by email or in-app notice before the new terms take effect. Continued use after the effective date constitutes acceptance.
13. Governing law
These Terms are governed by the laws of [JURISDICTION], excluding its conflict-of-law rules, and disputes will be resolved in the courts of [JURISDICTION].
